Hawksbill Retreat Lease Agreement

Your booking includes the number of guests as you indicated (ALL GUESTS – Adults and children).  You may add additional guests up to 24 hours before check-in as long as you do not exceed the maximum number of guests.  All cabins have a base rate and then an additional fee for extra guests.  We ONLY accept major Credit Cards. We do NOT accept Prepaid Credit Cards. 

THE CABINS HAVE A MAXIMUM NUMBER of GUESTS as follows:  2 Adults in the one-bedroom cabins, 8 GUESTS in MARE HOUSE and a maximum of 30 GUESTS in the LODGE – (ADULTS, CHILDREN AND DAY GUESTS) AND YOU AGREE THAT THIS MAXIMUM WILL NOT BE EXCEEDED (INCLUDING DAY GUESTS) AT ANY TIME. OUR CABINS ARE FOR LODGING PURPOSES ONLY, ABSOLUTELY NO PARTIES, WEDDINGS.  ABSOLUTELY NO PETS ARE ALLOWED ON THE PREMISES. THE PARKING AREAS ARE MONITORED.  IF YOU ARE FOUND TO HAVE MORE GUESTS ON SITE THAN THE  NUMBER OF GUESTS YOU PAID FOR (ADULTS, CHILDREN AND DAY GUESTS) OR IF WE FIND ANY ANIMALS, YOUR ENTIRE PARTY WILL BE IMMEDIATELY EVICTED WITH NO REFUNDS GIVEN. 

CHECK IN: 4:00PM. CHECK OUT: 11:00AM. (Early Check-ins and Late Check-outs are not permitted). If you do not adhere to these times, you will be charged an additional day. Everyone in your party must be out of the house and off the premises by 11:00 AM on the day of check-out. We do not allow partial stays or allow different numbers of guests for different days. The MAX number of guests present during your stay will be charged for the entire stay and is solely left to the discretion of the representatives of Hawksbill Retreat, LLC. All policies in this rental agreement are strictly enforced and by signing the rental agreement, you are agreeing for us to charge the credit card/ cards on file if the terms have not been met or have been disregarded. 

  1. The use / flying of drones while on our property is STRICTLY FORBIDDEN. The use of a drone while on our property will cause the device to be confiscated and may cause your entire group to be immediately evicted with NO REFUNDS.
  1. DO NOT USE FLUSHABLE WIPES! Flush only TOILET PAPER and HUMAN WASTE. The flushing of “Flushable” wipes, feminine hygiene items, wipes, paper towels or other trash WILL clog the sewer lines and cause damages. If a sewer line is clogged during your stay, the fee to clear the sewer lines is a minimum of $500 and any other related damages / cleaning expenses will be charged to the credit card on file.
  1. Campfire in designated area only. FIREWORKS are NOT permitted. We do not allow camping on the premises (no tents, RV’s, shelters, or campers). 
  1. NO SMOKING inside the cabin. Dispose of cigarette butts in ash trays. Do not throw butts in the yard or driveway. 
  1. Prior to checkout, Guest agrees to perform the following: (A) Sweep or vacuum any debris on floors and clean all spills on floors and in refrigerator, microwave, oven, furniture, cabinets and counter tops. (B) Load all dirty dishes in dishwasher. (C) Remove all used bed linens (sheets, pillowcases and towels) and place them in the laundry room. (D) Close and lock all doors and windows and turn OFF all ceiling fans, lights (including exterior lights) and TV’s. (E) Empty ALL trash cans (All trash MUST be placed in trash bags and handles tied before placing it in the outside trash containers). (F) Pick up ALL trash left in yard and around fire pit area, this includes cans, bottles, bottle tops and other trash. (G) If the grill is used, make sure it is turned off after use. Failure to complete these items could result in an additional excessive cleaning fee of $150.00 will be charged to the Credit Card / Cards on file associated with your booking. A copy of this checklist is in all properties. 
  1. Enjoy our property as if it were your own, as you will be held responsible for any damaged / missing items. IMPORTANT If any drinks or fluids are spilled on ANY of the floors, IMMEDIATELY clean it up. Failure to quickly clean up spilled drinks or liquids can warp the floors and / or cause damage to them for which you WILL be held responsible for all costs to repair / replace the damages. The cabins do not have a mailbox, items cannot be shipped to the cabin. We are not responsible for any items that you may have shipped to the cabins. If you have items shipped, it’s at your sole discretion, as we will not hold or receive any items. We are not responsible for any lost or stolen items. 
  1. Linens are provided. Sheets and pillowcases must be used at all times. 
  1. No hunting or target practicing on property. Firearms and BB guns are NOT permitted on the property. 
  1. OUTDOOR NOISE / QUIET TIME: Hawksbill Retreat has multiple cabins. Please be aware that Page County does have a noise ordinance and to respect guests at other cabins, quiet times shall be observed from 10:00 PM through 8:00 AM. We want everyone to have a good time. Please be respectful of others and be aware that noise travels. If noise (As determined by representatives of Hawksbill Retreat, LLC, or members of Page County Sheriff’s office) is determined to be excessive (AT ANY TIME) you will be asked to quiet it down. Refusal to follow these requests may result in immediate eviction from the property for you and all your guests related to your booking and NO REFUNDS WILL BE GIVEN. 
  1. Guests agree to abide by all rules and regulations contained therein related to leasing of the Property. Guests’ obligations include but are not limited to keeping the premises as clean and safe as the conditions of the premises permit and creating unsafe conditions in the common area and remainder of the premises that Guest uses. Guests agree not to use the premises for any commercial activities or purpose that violates any criminal law or governmental regulation. Guests’ breach of any duty contained in this paragraph shall be considered material and shall result in the termination of guest occupancy with no refund of any kind. 
  1. CANCELLATION POLICY: Once the booking has been accepted, if canceled, the Guest will NOT receive a refund. Booking dates may NOT be shortened. If your numbers of Guests increase, it is the responsibility of the person making the reservation to contact us regarding any changes. 
  1. In no event shall the leased Property be occupied by more people than the capacity of the property as stated on the website or the confirmation / welcome letter, without prior approval by Hawksbill Retreat, LLC. The credit card holder/ responsible party must be 25 or older and staying on the property for the dates booked. The person/ people who sign the rental agreement MUST be at the property upon arrival and departure, no one in the party is allowed to check-in before the signed renter or stay after the signed renter has checked out. No fraternities/ sororities, school, civic, or other non-family groups are allowed unless Owner grants prior approval. There must be a person responsible / person, 25 and older, to supervise any underage children in your party, either in the home or on the premises. No one under the age of 18 is to be left alone on the premises, for any reason, during your stay. If 2 or more cabins are rented by the same guests, children (18 and younger) are NOT to be left alone on any of the premises without adult supervision. Weddings and/ or outdoor parties are NOT permitted on any of the premises unless allowed by the owners and all the owners’ stipulations are followed for the events. In no event shall Guests assign or sublet the leased Property as a whole or in part. Violations of these rules are grounds for expedited eviction with no refund of any kind. Guests hereby acknowledge and grant specific permission to representatives of Hawksbill Retreat, LLC, to enter premises at any time for inspection purposes should representatives of Hawksbill Retreat, LLC reasonably believe that Guests are causing or have caused any damage to leased Property or if there are more guests than have previously been paid for. Guest further agrees to grant representatives of Hawksbill Retreat, LLC, access to leased Property for purposes of maintenance and repair. 
  1. PET POLICY: None of the Hawksbill Retreat cabins allow any pets of any kind. Any parties found with a pet(s) will be immediately evicted from the premises and forfeiture of all monies paid and a non-declared pet charge of $200.00 per pet per night or any portion thereof at the sole discretion of representatives of Hawksbill Retreat, LLC. In the event we find a pet in the leased property or find ANY evidence of a pet having been in the leased property, we will require an additional $200.00 pet cleaning fee charged to the credit card or cards used for the reservation. 
  1. Damages are the sole responsibility of Guests. Examples of damages include but are not limited to the Hot Tubs or Hot Tub accessories (a) intentional, willful, reckless, or malicious acts of Guests or others on the premises during the tenancy; (b) theft from the premises of either Owners Property or property belonging to Guest; (c) gross negligence of Guests or intentional misuse of furnishings, appliances, equipment, or other amenities provided within the home; (d) damage caused while under the influence of alcohol or drugs; (e) damages to real property resulting from operation of any motorized vehicle by Guest: (f) damage to home from any type of pet. 
  1. No refunds will be provided due to inoperable appliances such as Hot Tubs, Wi-Fi, refrigerators, stoves, coffee makers, blenders, etc. and /or nonworking utilities such as electricity, water, plumbing, heating/ cooling, etc. We do keep spare appliances on hand but sometimes things fail, and we may have to wait for a repair technician. Hawksbill Retreat, LLC will make every reasonable effort to assure that such appliances and/ or utilities will be and remain in good working order. Also, no refunds will be given due to power blackouts, water shortages, flooding, snow, blizzards, tornadoes, quarantine, pandemics (Covid-19 or others), construction at adjacent properties, or mandatory evacuations due to hurricanes or other potentially dangerous situations arising from ANY acts of God or nature. 
  1. LOST AND FOUND: A $50.00 fee, plus shipping cost, applies to any lost and found items that Hawksbill Retreat, LLC, is requested to return to Guests. Items found and not claimed within 30 days of checkout will be disposed of at the sole discretion of representatives of Hawksbill Retreat, LLC. The Return item will be shipped to the person booking the property and the credit card on file will be charged the fee. 
  1. HOT TUBS: The Hot Tub will be prepared and tested for proper and safe chemicals prior to or on the day of occupancy. Misuse of the Hot Tub by the spilling of foreign substances into the tub, for example Alcohol, Soap, Shampoo, oils, tanning lotion, glass or metal will result in a $150.00 Service Call Charge. Under no circumstances are pets allowed in Hot Tubs. Children 18 and under must be supervised by an adult during their use of the Hot Tub. DO NOT stand, sit or place items on the Hot tub cover as doing so can damage the cover and you will be charged $500.00 for cover replacement. The violation of these provisions shall be grounds for expedited eviction. 
  1. LINENS/TOWELS: Guests are responsible for lost or damaged items at the cost of two (2) times the published standard rental price for such damaged/lost linens/towels. Towels, linens, or blankets are NOT to be taken outside or removed from the home. 
  1. In the event Hawksbill Retreat, LLC is unable to make leased Property available for any reason other than described above or a reasonable substitute as determined by representatives of Hawksbill Retreat, LLC, Guest agrees as a result of this unavailability the sole and only liability of Hawksbill Retreat, LLC is to provide a full refund of all monies paid under this Agreement and Guest expressly acknowledges that in no event shall Hawksbill Retreat, LLC or its representatives be held liable for any special or consequential damages which result from this unavailability. Guest also agrees to indemnify Hawksbill Retreat, LLC and/or its representatives from and against all liability for injury to Guest or any other person occupying leased Property resulting from any cause whatsoever including, but not limited to, injury sustained as a result of use of Hot Tub, whirlpool tub, etc. 
  1. Hawksbill Retreat, LLC may terminate this Agreement upon the breach of any of the terms hereof by Guest. Guest shall not be entitled to the return of any lease monies paid under the terms of this Agreement and shall vacate the Property immediately. 
  1. I understand the rules and conditions upon which I agree to lease accommodations, equipment, and use of the property. I acknowledge and accept the sole responsibility for safety lies with the participant. I acknowledge that outdoor, mountain, water, and camping activities and exposure to the natural elements and animals can be dangerous and sometimes result in injury and even death. Riverbanks, streams, steps and decks can be slippery, animals and insects can threaten and infect or injure, exposure to the elements can cause hypothermia, sunburn, among other risks inherent in participating in camping, outdoor and water activities. I understand that alcohol and/or drugs do not mix with any outdoor activity. Furthermore, I agree that: I am over the age of 25 (and assume responsibility for those in my charge under the age of 21.) I hereby assume all legal responsibility for bodily injury to me or to any person on the property as a result of my visit and use, operation or possession of equipment hired or loaned to me. Acknowledging this, I accept complete responsibility for the minor children, guests and myself in my charge and when leasing any Property, equipment and engage in activities or events at my own risk. I agree to hold harmless and to indemnify Howan Properties LLC, its representatives and the Owners against all loss, damage, expense and penalty on account of personal injury or property damage to the rental dwellers, the undersigned or to any minor child or children in the charge of the undersigned, howsoever rising, whether by act or acts or failure to act of the employees, Owners or animals of the said company or property owners or not. I acknowledge receipt of the property in good order and condition (if found otherwise per my arrival I will contact Hawksbill Retreat, LLC immediately at 1-888-452-2246) and further agree that Hawksbill Retreat, LLC and/or its representatives of the property shall not be liable for consequential damages of any kind or nature from whatever cause arising, whether property or equipment is loaned or rented. I enter into agreement freely with Hawksbill Retreat, LLC at my own risk, acknowledging the risks inherent in outdoor and river activities and assume any and all responsibility for the minor children and myself in my charge. All properties are in the woods or in wooded areas and are susceptible to insects and wildlife. Hawksbill Retreat, LLC is not held responsible for and will not refund any money for any property rentals with insects or animals of any kind in them or around them. Preventative pest control measures are performed on a quarterly basis. All parties agree to and will comply with Federal, State and County pollution laws and any other applicable laws and regulations. 
  1. This Agreement shall be enforced under the laws of the State of Virginia, including the VA VACATION RENTAL ACT, and represents the entire Agreement. Any amendments must be in writing and signed by both parties. In the event of a dispute, legal action may only be instituted in Page County Virginia within which the leased Property is located. If any part of this Agreement shall be deemed unenforceable by law, that part shall be omitted from this Agreement without affecting the remaining Agreement. Hawksbill Retreat, LLC shall conduct all brokerage activities regarding this Agreement without respect to the race, color, religion, sex, national origin, handicap, or familial status of any Guest.
